1. Definitions and Interpretation

1.1. In these Terms and Conditions:

  • a) ‘Affiliate’ means in relation to any person, any other person which directly or indirectly through one or more intermediaries, controls, or is controlled by, or is under common control with, that first person. As used in this definition, ‘control’ (including with corresponding meanings, ‘controlled by’ and ‘under common control with’) shall mean possession, directly or indirectly, of power to direct or cause the direction of management or policies (whether through ownership interests or otherwise). To avoid doubt, Affiliate may also be used to refer to franchisees;
  • b) ‘Application’ means the application or registration submitted by You via the Brumby’s Bakery Website or select Brumby’s Bakery Stores to become a Member of the Brumby’s Bakery Rewards Club Program;
  • c) ‘App’ refers to an online app downloaded from the Apple or Android stores for use on applicable Apple or Android devices.
  • d) ‘Benefits’ means the services, products, discounts, offers, activities and events or arrangements offered or available to Members from time to time;
  • e) ‘Credit’ or ‘Credits’ means the monetary value stored on Your Brumby’s Bakery Rewards Club account that remains available to you (expressed in New Zealand Dollars) from time to time;
  • f) ‘Brumby’s Bakery’ means CCBS (NZ) Ltd, Trading As Brumby’s Bakery;
  • g) ‘Brumby’s Bakery Rewards Club Program’ means the loyalty rewards and prepaid cards program operated by Brumby’s Bakery and includes but is not limited to the Brumby’s Bakery Rewards Club Card;
  • h) ‘Brumby’s Bakery Rewards Club Card’ means each membership card issued by Brumby’s Bakery to each Member and includes but is not limited to the Brumby’s Bakery Rewards Club Card/App;
  • i) ‘Brumby’s Bakery Website’ means www.brumbys.co.nz or such other website as is nominated by Brumby’s Bakery from time to time in its absolute discretion;
  • j) ‘Dollar’ or ‘$’ means New Zealand Dollars;
  • k) ‘Device’ means any equipment used to access the Brumby’s Bakery Rewards Club Card or App;
  • l) ‘Eligible Transaction’ means the purchase of any full priced “made in store” hot or cold beverage, bread and rolls You make from selected Brumby’s Bakery stores when you use an approved payment (whether it is cash, cheque, credit card, Online, EFTPOS or your prepaid Brumby’s Bakery Rewards Club Card) and You submit your registered Brumby’s Bakery Rewards Club Card at the time of purchase;
  • m) ‘Member’ or ‘Membership’ means a member of the Brumby’s Bakery Rewards Club Program;
  • n) ‘Online’ means connected to, served by, or available through a system and especially a computer or telecommunications system (such as the Internet) or an online database connected to such a system, including an online shopping system, such as the Brumby’s Bakery Rewards Club App;
  • o) ‘PIN’ means the Personal Identification Number nominated by you when registering Your Brumby’s Bakery Rewards Club Card/App, which must be entered by You when using Your Brumby’s Bakery Rewards Club Card/App in relation to any transaction at participating Brumby’s Bakery outlets;
  • p) ‘Points’ means the points earned by You on Eligible Transactions in accordance with these terms and conditions;
  • q) ‘You’ or ‘Your’ means the individual who submits an Application to become, or is, a Member of the Brumby’s Bakery Rewards Club Program.

2. Introduction

2.1. Brumby’s Bakery Rewards Club is promoted by, issued and remains the property of Brumby’s Bakery.

2.2. This document sets out the Terms and Conditions of the Brumby’s Bakery Rewards Club Program provided by Brumby’s Bakery (‘Terms and Conditions’).

2.3. Your use of Your Brumby’s Bakery Rewards Club Card/App is deemed acceptance of the Terms and Conditions.

3. Membership

3.1. To become a Member, You must:

  • a) collect your Brumby's Bakery Rewards Club Card with the purchase of any food or drink item at select Brumby’s Bakery stores; and
  • b) register in your Brumby’s Bakery store;
  • c) or download the Brumby's Bakery Rewards Club App from Apple or Android stores, and complete the required registration.

3.2. Brumby’s Bakery reserves the right to decline any Application for any reason in its sole and absolute discretion.

3.3. Points will not commence or accrue until Your Application is approved and accepted by Brumby’s Bakery and your Brumby's Bakery Rewards Club Card has been successfully registered.

3.4. A Brumby's Bakery Rewards Club Card/App is not transferrable and remains the property of Brumby’s Bakery at all times.

3.5. Membership may be cancelled or refused by Brumby’s Bakery at its absolute discretion if a Membership is deemed to be fraudulent or linked to a fraudulent Membership. In this case all Credits, Points, Benefits and Rewards will be immediately cancelled or forfeited.

3.6. Membership is limited to one Brumby’s Bakery Rewards Club account per person, and only one account can be created per email address.

4. Points

4.1. Once Your Brumby's Bakery Rewards Club Card/App is registered, you will automatically be entitled to 600 Points, the rough equivalent to one Brumby’s Bakery sandwich loaf or a small barista-made drink, on the presentation of your Brumby's Bakery Rewards Club Card/App.

4.2. To thereafter accrue Points, you must present Your Brumby's Bakery Rewards Club Card/App each time You make an Eligible Transaction.

4.3. You will be awarded ten (10) Points for every dollar (or part dollar) spent in an Eligible Transaction on Brumby’s Bakery “made in store” loaves and bread rolls & hot or cold beverages. For example, in a single Eligible Transaction totalling $4.90, You will be rewarded with 49 Points.

4.4. One point equates to the value of one cent. For example, 100 points values $1.00.

4.5. Only Brumby’s Bakery freshly baked loaves, rolls and barista-made drink items are valid to accrue and redeem Points as part of the Brumby's Bakery Rewards Club Program.

4.6. Points cannot be earned in conjunction with free or discounted purchases, special offers or promotions.

4.7. Accumulated Points will entitle You to redeem those Points in exchange for a free hot or cold barista-made beverage, loaf, or bread roll of your choice to be used at selected Brumby’s Bakery stores.

4.8. Points can be redeemed for a maximum of two items in a transaction.

4.9. Points cannot be exchanged for cash.
